Before you make use of our digital photo printing service and set up your free account with First4Fotos, you need to carefully need read the following Terms of Use . To make things read easier, First4Fotos will be referred to as “we” and the client as “you” in the continuing text. Please read all this information carefully!
1. Access to your online photo account
We offer you an account at no cost to you, as long as this account is used exclusively in a personal or private capacity.
Note that commercial use of this website is prohibited. To link to images on the First4Fotos digital printing servers from external internet sites is expressly not allowed.
Our site administrator will need to have access to your First4Fotos account for the reasons listed below:
- In the event of you forgetting your password, you can request us to send an email to the e-address from which you initiated the account.
- To maintain our service to you on an ongoing basis, as well as develop new digital photograph features and online printing services.
- If our legal department needs to action a court order, subpoena complaint or lawful request from relevant government authorities.
We reserve the right to shut accounts set up for fraudulent or criminal purposes. 2. Image Restrictions/ Limitations (including Copyright and Trademark Laws)
Under these Terms and Conditions, you are unequivocally forbidden to place any of the following material (or attain such material) using our application:
- No threatening, obscene, lewd, profane material or pornographic images that could give rise to civil or criminal liability under applicable UK law
- No material or image that could infringe rights of privacy, publicity or copyrights whatsoever, without the express permission of the owner of these rights and the persons (or their parents or legal guardians, if applicable) who are featured in the digital photo images.
While we are in no way responsible for the images contained on the files uploaded to our site, we do reserve the right to delete/edit images that are viewed as abusive, defamatory, obscene or in direct violation of pertinent copyright/trademark laws.
We may require confirmation of the copyright/trademark ownership from you and we reserve the right to hold back shipping of an order before this confirmation is received. If confirmation is not forthcoming – or if claims of copyright/trademark infringement are raised – we hold the right to share relevant information with government departments or other third parties.
However, if you dispute the aforementioned infringement claims, we will freely share with you the contact details of the person or party lodging the claim. If such a dispute should arise, we reserve the right to suspend the display of such images until the matter has been effectively resolved.
Hereby, you also acknowledge that an uploaded image may be removed, published, copied, modified, transmitted and displayed by us for the purpose of delivering the offered digital print services. You additionally warrant that all moral rights in any uploaded images and materials have been waived.
We will not be liable for the content of any image or materials submitted to our site.
Copyright Protection
Our company strongly discourages the violation of photographers' copyrights. Every client of our digital photo processing laboratory is required, by appropriate law to either
- Own the right to every image uploaded to our site; and/or
- Present proof of permission to use a protected image before the image is uploaded to the First4Fotos site and processed into a digital photo print.
Should it come to your attention that any copyrighted image of yours has been illegally copied or represented, contact us at the address below and furnish all the pertinent information

3. Age requirements
If you are not yet thirteen years old or older, you may not access or use our site. Concerned parents or guardians are welcome to contact us.
4. Cancellation of Service
We reserve the right to cancel the Service or to close accounts that have been inactive for more than two hundred (200) consecutive calendar days. You will be notified of our intent to discontinue your account with an email to the address from which you initiated your account. From date of delivery, you will have fourteen (14) days to respond to the email before we remove your account and any images stored therein.
5. Links
Part of our service and features will be links to other websites that are of general interest to the amateur photographer buying online print .
Note: we have no control over the content or availability of these links. Please familiarize yourself with each site's Privacy and other policies and terms of service. Contact the Webmaster or site administrator with your concerns or questions about digital online print services or advice directly.
6. Copyrighted material and software
Our content, information, software and other materials are protected by stringent copyright and other relevant laws. Copying and/or distribution of such material without the owner's written permission is prohibited. Personal non-commercial use of such photo material or digital printing information is allowed, on the condition that no copyright or similar proprietary rights are removed.
7. Privacy Policy
Personal information given by you - name, email address and mailing address - will be appropriately protected as stipulated in our company's Privacy Policy.
8. Indemnity Clause
You agree to indemnify, defend and render harmless First4Fotos, our officers, directors, digital printing services , employees, registered agents, licensors, suppliers and any additional third-part information providers to the Service from and against all losses, expenses, damages and costs, including equitable legal fees, resulting from any violation of these Terms or any activity connected to your account (negligence and wrongful conduct included) by you or any other individual accessing the Service using your account details
9. Claims Period
Legal action hereunder must be brought – if at all – within one (1) year from the time of the cause of action. Both parties must be in agreement that any claims hereunder shall be subject to English law.
10. Disclaimer of Warranties
Our content and/or materials are provided on an “as is” and “as available” basis, with no warranties of any nature either express or implied.
We disclaim to the fullest extent all warranties and conditions of any kind be they express or implied, as allowed by applicable law. This includes, but is not limited to, implied warranties of merchantability, fitness for a specific purpose and non-infringement.
Furthermore, we make no warranty that our site and related services will be free of errors, uninterrupted, timely, nor that it will offer online security and that our site and server will contain no viruses or other harmful components. Additionally, we also make no warranty regarding any software, goods, services, special offers, or the delivery of any software, goods and services, purchased, accessed or obtained through our photo processing website or advertised through First4Fotos.
11. Limitation of liability
Under no circumstances shall we be liable for any indirect, incidental, special or consequential damages of images or material sent to us. This includes, but is not limited to, damages for loss of profits, use, data or other intangibles, even if we have been notified of the possibility of such damages, resulting from the utilization or the inability to use our site or digital printing service for your printing needs. This also applies to any changes to our site or its associated services, or from unauthorized access to or alteration of your electronic transmissions or data. Note: selected UK jurisdictions do not allow the limitation of incidental, consequential or other types of damages, so some of the above limitations may not be enforceable.
12. Policy and Procedure for Idea Submission
We appreciate your input into improving our service and features. However, submission of ideas for products and services, either independent of, or in conjunction with our intrinsically developed concepts, needs to be clarified herein. If you are thinking of submitting an external design/idea submission, our policy is as follows:
- Unsolicited material submitted to us or our employees, automatically and immediately becomes our property.
- All rights to the intangible or intellectual rights of these ideas are waived by submitting unsolicited material to us.
Should it be your intention to own the intellectual property or patent rights of your concept/ideas by way of patent, trade secrets, copyright, trademark et al, please do not submit these or any prototype samples to our company.
We would advise that your send a short message to support@First4Fotos.com , only describing the general application in its broadest terms. We will contact you should we feel there is merit in exploring the submitted proposal further. A proper legal agreement may need to be drawn up in order to perform a proper evaluation of your concept or idea.
13. General
We may assign our rights and responsibilities hereunder without notice to you.
Items purchased via us are made pursuant to a shipment contract. Effectively, this translates into the risk of loss and title for such items is passed to you on our delivery to our selected carrier.
Should it be necessary, we reserve the right to ship partial orders, at no additional cost to you. The cost of this partial order may be charged to your credit card at the time of shipment.
If any section of this Agreement is held to be invalid or unenforceable, then the invalid or unenforceable provision will be deemed superseded by an valid, enforceable provision most directly matching up to the intent of the original provision. All remaining Terms will continue in effect.
The Terms and Conditions stated here constitute the entire agreement between you and us with respect our online digital camera print Service, and supersede all other communications, written or oral, with regard to the Service.
